General conditions

(pursuant to Chapter I, title 3, part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

 

  1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter: “General Conditions”) regulate the purchase of products, carried out remotely and made available via the Internet, from the site https://valverbe.it (hereinafter: the “website“) in compliance with Italian legislation, pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the “Consumer Code“).

The seller of the products and owner of the Site is: VALVERBE SOC. AGR. COOP. with legal and production headquarters in Via PRATO, 9 12020 MELLE (CN) P.I. 02464530043 – Email address: shop@valverbe.it.

 

The consumer who accesses the website to make purchases (hereinafter “Customer“) is required, before sending the order, to carefully read these General Conditions which have been made available to him on the website and which will be available at any time in each order confirmation email through a link, thus they can be reproduced and memorized.

In the event that the person who makes purchases on the Site requests the issuance of an invoice and/or in any case is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a, of the Consumer Code, the discipline of withdrawal pursuant to art. 7 of these General Conditions,  and more generally, the provisions which, pursuant to the same Consumer Code, apply only to “consumers”, will not apply.

Contracts concluded through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

 

  1. Choose and order the Products

The characteristics and price of the various products on sale on the website (hereinafter the “Product” or “Products“) are shown on the page relating to each Product.

 

For organizational reasons, of a technical and logistical nature, orders of less than €8 are not accepted

 

To purchase the Products, the Customer must complete and send the order form through the Internet, following the instructions contained on the website. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Policy of Privacy and confirmed their acceptance, he will have to enter the shipping and billing data, select the desired payment method and confirm the order.

 

By sending the order from the website, which has the value of a contractual proposal, the Customer acknowledges and declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these transcribed General and Payment Conditions.

 

The contract stipulated between the Supplier and the Customer must be considered concluded with the acceptance of the order by the VALVERBE company, acceptance which is communicated to the Customer through an email confirming the order itself, containing a reference to these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. Should the Customer find errors in the order placed, it will be possible to cancel the order within the following 12 hours of receiving the confirmation email, by sending an email to shop@valverbe.it, or by calling 0175.978276. After this term, the order will be processed for shipment and changes or cancellations will no longer be accepted, without prejudice to the Customer’s rights referred to in article 7 below.

 

Once the order has been received, the company will check the availability of the warehouse to process the order. In the event that one or more Products should be unavailable, timely communication will be sent via e-mail to the Customer, who, within the following 12 working hours, will have the right to reply to confirm the shipment of the available Products, provided that the total order meets the minimum order required to be shipped, or to cancel it. In case of no response within this period, the order will be considered automatically cancelled.

In case of order confirmation, the amount relating to the missing Products will be reversed according to the chosen payment method.

 

  1.     Product Information

The information and characteristics relating to the Products are available, with the relative Product codes, on the Site.

 

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and qualities but may differ in color and size.

In case of difference between the image and the product sheet, the description of the product sheet always prevails.

 

  1.     Prices and shipping

Product prices include all applicable taxes and duties. All prices are expressed in Euros.

 

  • Shipping to Italy:

Throughout Italy, shipping is free for amounts over €45 (islands excluded), for lower amounts the cost of shipping is €5.90 per order. For shipping to the islands, the cost of shipping is €9.90with no amount restrictions.

 

  • Shipments abroad:

The cost of shipping abroad varies according to the destination and will be processed upon request for a quote from the customer.

 

  1.     Methods of payment and billing

 

5.1 Payment Methods

The payment of the price of the Products and the relative delivery costs can be made by credit cards, prepaid cards, PayPal or bank transfer.

 

  •     Credit cards or prepaid cards

The circuits on which it is possible to buy on the site are:

MasterCard

 

 

  • PayPal

Once the order has been confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a card, even a prepaid one, or in any case according to the methods accepted by Paypal and by his credit institution and in compliance with the related conditions.

 

 

5.2 Billing of orders

If the purchase is made by a company with a VAT number, it will be possible to request the issuance of the invoice by entering the billing data – including the tax code and/or VAT number – in the appropriate form to be filled in before concluding the purchase. order or by writing an email to shop@valverbe.it. The professional is responsible for entering the billing data correctly and is expressly informed that, if the invoice is not requested during the order phase, it will not be possible to request it later.

 

  1. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate “Shipping Data” field.

 

All purchases will be delivered by express courier (hereinafter, “Courier“) from Monday to Friday, excluding holidays and national holidays.

The company is not responsible for unforeseeable delays or in any case not attributable to it.

The user is required to make a person available for unloading, indicated in the “destination of goods” field on the basis of the delivery confirmation received from the courier via text message or e-mail.

7 . Right of withdrawal

The exercise of the right of withdrawal is subject to sending to Valverbe a communication by suitable means (mail to shop@valverbe.it, registered letter with return receipt) no later than 14 days from receipt of the product.

Once the communication has been received, the company will open a case for the management of the return, it being understood that the cost of returning the product is charged to the customer.

 

The right of withdrawal is governed by the following conditions:

 

  1. The Customer has the right to withdraw from the purchase contract only in the event that the product received does not comply with the order confirmation or the product sheet, or in the event of transport damage that jeopardizes its usability (e.g. in the event of breakage, crushing, contamination), provided that such damages are documented at the time of delivery with a specific signature on the courier’s tablet.

 

  1.  Reimbursement is subject to receipt of the Product by Valverbe, which, once the damage or non-compliance has been verified, will refund with the same payment method used by the customer when purchasing the Products.
  2. Errors and Limitations of Liability

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which, therefore, VALVERBE cannot be held responsible, except in cases of willful misconduct or gross negligence.

VALVERBE reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by non-acceptance or evasion, even partial , of an order.

 

 

9.Complaints

Any complaint must be forwarded to VALVERBE, using the email shop@valverbe.it, or by calling +39 0175 978276 from Monday to Friday, from 8.30 to 12.30 and from 14.00 to 17.00 excluding public holidays, or by registered letter with return receipt to the following address:

The company undertakes to respond to all requests received within a maximum of 15 working days.

 

10.Applicable law and jurisdiction

The sales contract between the Customer and the VALVERBE supplier is understood to be concluded in Italy and governed by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, the Court of Cuneo will be exclusively competent.

Pursuant to article 1341 of the civil code the Customer declares to have read and to specifically accept the following articles of these General Conditions: 1 (introduction), 2 (choose and order products), 3 (product information), 4 (prices and shipments), 5 (methods of payment), 6 (transport and delivery conditions), 7 (rights of withdrawal), 8 (right to correct errors – exclusions of liability), 9 (complaints), 10 (competent court).
